MYWLAN TERMS OF USE
– Terms of Use
The following Terms of Use („Terms“) regulate all aspects of using the mywlan.at website („Webite“), mywlan Facebook, Twitter, Instagram Application („App“) and all content, products and services available on or through the Website („Services“). Website and Application are owned by AntoreA IT Solutions e.U.. Website and Application are owned by AntoreA IT Solutions e.U. You must be over 13 years old to use our services. This age limit may be higher in particular locations according to their Terms (such as Clubs, Casinos, Betting shops, etc.).
The prerequisite for using our services is acceptance without modification of all the Terms and Conditions contained herein and and the Privacy Policy, as well as in any other operating rules, policies and procedures that may be posted on this website every now and then. Please read these Terms and Privacy Policy carefully before using this website and mywlan services. By accessing or using any part of our services, you agree with all the provisions prescribed by this document. If you do not agree with all provisions, you can not access or use any part of our services.
2. How to register on mywlan and use free Wi-Fi on location
Mywlan offers you the possibility to use the free Wi-Fi internet access which mywlan clients („Clients“) offer (end-users) in their restaurants, cafes and in other locations. Connecting to the Internet through a WiFi network is possible through authentication in one of four ways:
– Login with Facebook
You can use Clients’ free Wi-Fi by login with your Facebook account, allowing access to our Facebook Application and by „Liking“ the Facebook page of extension. The username and password you use to access Facebook will also allow you the access to free Wi-Fi.
You must accept our Facebook Application only once, when you use mywlan for the first time. Every time you visit a new extension, you will be asked to „Like“ the Facebook page of that extension. When you next visit the same location, login will be automatic, in accordance with our Policy of using Cookies.
In login process, mywlan App will ask for access to the following personal data accessible on profile of your Facebook account:
– Your public profile
– List of your friends who also use mywlan
– Your email
– Your birthday
– Your „Likes“
All other data except public profile are optional and in the course of accepting the Application, you can choose what data will you make available.
In order to provide service, mywlan will collect and use only the following information from your public profile:
– Your Facebook ID
– Your Facebook name
– Your sex
– The number of your friends (not their names)
By accepting our Facebook App, you agree to our access and use of aforementioned personal data about you. When you install our Facebook App to your Facebook account, and when you „Like“ the Facebook page of the Client, the application process will be automatical each time you log into free WiFi of same client.
You can also choose the option of receiving promotional offers from Clients you have visited.
If you use your Facebook account to sign in, only you are responsible for maintaining the security of your Facebook account fully responsible for all activities that occur under this account and any other actions taken about this account. In the case of unauthorized use of your Facebook account or any other breach of security you are required to immediately notify mywlan. Mywlan will not be responsible for any actions or omissions by you in this regard, including damage of any kind incurred as a result of such acts or omissions. NOTE: Mywlan at no time has no insight into nor keeps your login data for Facebook, such as email address and password. Login process is done within the Facebook and mywlan services, only allows access to the Facebook login page.
– Twitter login
You can use free Wi-Fi of Client by logging to your Twitter account. The username and password you use to access Twitter will also provide access to free Wi-Fi Internet.
As soon as you login using your Twitter account, you can become a Follower of extensions Twitter account. . You hereby agree that mywlan Twitter Application accesses your account and perform the following actions:
– Read the Tweets from the Timeline
– Posts Tweets on your behalf
– Has insight into who you’re following and who is following you
In order to provide services, mywlan will collect and use only the following information from your Twitter profile:
– Your Twitter Name
– Your Twitter ID
– The number of people following you (not their data).
If you use Twitter to connect to our services, you are responsible for maintaining the security of your Twitter account and fully responsible for all activities that occur under this account and any other actions taken at this account. In case of unauthorized use of your Twitter account or any other breach of security you are required to immediately notify mywlan. Mywlan will not be liable for any actions or omissions by you in this regard, including any damage of any kind incurred as a result of such acts or omissions.
– Instagram login
You can use a client’s free WiFi by signing in with your Instagram account. Your user name and password for accessing Instagram will also enable access to free WiFi Internet.
For the purpose of providing the service, mywlan will collect and use only the following data from your public profile:
– Your Instagram name
– Your Instagram ID
– The number of people who follow you (not their data)
Once you sign up via your Instagram account, you can become a Follower of the Instagram account of the location. This choice is optional.
NOTE: mywlan at no time has no insight nor keeps your login information on Facebook, Twitter or Instagram, such as email address and password. The login process is done within the social network itself and mywlan service allows just access to their sign-in pages in order to register to our free WiFi . Whether you use Facebook, Twitter or Instagram to connect to our services or not, you are solely responsible for preserving the security of your accounts and fully responsible for all the ongoing activities within these accounts and any other actions taken concerning these accounts. Mywlan will not be liable for any actions or omissions on your part in this regard, including any damage of any kind resulting from such acts or omissions.
– Login via email
You can use Free Wi-Fi of a Client by registering your name, email address, your gender and, depending on the location, your birth date (this is optional). Once you enter your email address in the login process, mywlan will check the validity of your email address in the background. User registration means the registration of a valid email address for communication between the user and mywlan. In the event of determining the invalid entered email address, you will be prompted to re-enter a valid email address. The registration is not possible with the invalid email address.
– Login with a mobile phone number
If you use a mobile phone, you can use a client’s free WiFi by registering your name, your phone number, your gender and, depending on the location, your birth date (this is optional). When you enter your phone number in the login process, mywlan will check the validity of the number by sending an access code with an SMS message to the number you have entered. User registration means registering a valid phone number for the communication between the user and mywlan. The registration is not possible with an invalid phone number.
– Login with a Password of the premises
In case you do not want to use any of offered ways of login, you can request a password from the premises‘ staff and thus login. In case of such login, there is no automatic process the next time you login, which is advantageous in terms of other forms of login. You will need to request login password every time you want to login in this way. 4. Your responsibilit
After the login process to free WiFi through mywlan system and your Internet access, your behavior on the Internet is solely your responsibility. You are responsible for taking precautions that are necessary for you and your computer, tablet or mobile phone, such as protection against viruses, worms, Trojans and other harmful or destructive content. Mywlan has no responsibility for any harm resulting from your use of websites or third-party applications, or by downloading content from sites or third-party applications or content that you sent there. You are also responsible for any unauthorized use of services by third parties using your Facebook or Twitter account in your name. We recommend that you keep you login information as top secret.
5. Relation of mywlan and Client (premises of company)
Free Wi-Fi and a broadband Internet access at Client’s location is not in any way part of the services offered by mywlan than exclusively and directly ownership and the responsibility of the Client. Mywlan activity is limited only to ensuring the login process by the methods described in paragraph 2. and to ensuring of communication mechanisms of Clients or of third parties with end users through promotions and campaigns aimed at end users. Mywlan is not responsible for the accuracy, reliability and quality of the offers, promotions and marketing campaigns that customers or third partiets offer to end-users.
6. Rights of mywlan
Mywlan reserves the right to use your personal information available on your public profile of Facebook and Twitter accounts as described in paragraph 2 in order to illustrate the demographics of end-users to their customers.
Mywlan reserves the right to deliver and display offers and promotions on services in connection with your use of our services and services of clients.
7. User rights
All mywlan users have the option to unsubscribe from mywlan mailing list (clicking on the link at the bottom of any promotional mail sent for and on behalf of mywlan). The user, in accordance with the legal regulations as well as the EU Personal Data Protection Regulation (GDPR), has the right at all times to request from mywlan the transparency regarding the manner and purpose of using the user’s personal data, as well as the insight, correction or deletion of all data collected from the user. 9. Conformity with Twitter
Mywlan App uses Twitter as a part of their services. When you accept our mywlan Twitter App, you still remain within the general Terms of Use and Privacy Policy of Twitter. Mywlan App is approved by Twitter it is in accordance with Terms of Use and Privacy Policy of Twitter
10.Conformity with Instagram
Mywlan uses the Instagram App as part of its services. When you accept our mywlan Instagram App, you will still be in the framework of General Terms and Conditions and Privacy Policy of Instagram. Mywlan App was approved by Instagram in accordance with the Terms of Use and Privacy Policy of Instagram.
11. Free use
Access, registration and use of mywlan services are free for end users.
12. Indemnification
You agree to indemnify mywlan, as well as directors, clerks, employees and agents from all claims and expenses, including attorneys‘ fees, which could result from your use of our services, including but not limited to your violation of these Terms of Use.
13. Copyright Infringement
As in mywlan we expect others to respect our intellectual property rights, we also respect the intellectual property rights of others. If you believe that material located on our website pages or affiliated with mywlan infringes your copyright, you are advised to immediately inform mywlan. Mywlan will respond to all such notices including removing the infringing material or disabling all links to the infringing material if necessary. Mywlan will disable visitor’s access and use of website and Application if it is established that visitor violated the copyrights of mywlan, intellectual property rights or other rights of mywlan for several times.
14. Intellectual Property
By these Terms and Conditions Mywlan does not transfer you any part of the intellectual property of mywlan or of third party, and all rights, ownership and interest in such property remains exclusively to mywlan. Name of mywlan, mywlan logo, and all other trademarks, service marks, graphics and logos used in connection with site and Applications are trademarks of mywlan. Other trademarks, service marks, graphics and logos used in connection with site and Applications may be the trademarks of third parties. Your use of the site and Application does not give you the right or permission to reproduce or otherwise use for any purpose trademarks of mywlan or of third party.
15. Amendments
In its sole discretion mywlan reserves the right to modify or replace any part of these Terms. It is your responsibility to periodically check the Terms changes. Your continued use of or access to data and Applications after the announcement of any change of conditions shows the acceptance of those changes. In the future, mywlan may also offer new services and/or functions of the site or Application. Such new features and/or services are also subject to these Conditions.
16. Termination
You may indefinitely remain registered and use free Wi-Fi and mywlan services at Client’s locations, until mywlan or Client provides services and free WiFi. You have the right to unsubscribe from our services at any time by going to Facebook and Twitter Settings and deleting our mywlan Application (App).
Mywlan reserves the right to suspend your access to all or any part of our services, at any time, with or without cause, with or without notice, especially if there is a reasonable suspicion that you violate the Terms of Use and Privacy Policy.
After termination of service if you want your personal information to be deleted from mywlan system, you can do so by sending an email to office@mywlan.at. Mywlan will notify you via email when your data is being deleted.
17. Applicable Law
These Terms of Use are in accordance with the Serbian law. For any disputes regarding the validity, interpretation or performance of these Terms the Commercial Court in Belgrade will be competent.
